MOTION TO BIFURCATE ISSUE OF PUNITIVE DAMAGES

COME NOW defendants, by and through their attorneys of record, and pursuant to R.S.Mo. §510.263, 2004, as amended, move the Court for an order granting bifurcation in this matter of the issue of the amount of punitive damages which are asserted in West Palm Beach Florida car accident Plaintiff s’ Second Amended Petition. As grounds for this motion, defendants state that pursuant to the above-described statute, upon the motion of any party, this court shall conduct a bifurcated trial on the issue of the amount of punitive damages before the same jury only after the jury has determined the liability of these defendants for punitive damages.

During the initial stage of trial, evidence of these defendants’ wealth shall not be admissible unless otherwise admissible on an issue other than punitive damages.

WHEREFORE, defendants pray for a bifurcated trial on the issue of the amount of punitive damages.
