What are the three safety requirements manufacturers have to include in bicycle instruction manuals?

In a lawsuit for products liability of a defective bicycle the design may be considered defective if the foreseeable risks of harm posed by the bicycle could have been reduced or avoided by the adoption of a more reasonable alternative design by the seller or other distributor, or a predecessor in the commercial chain of distribution, and the omission of the alternative design renders the product not reasonably safe. The Federal regulations issued by the Consumer Products Safety Commission requires that all bicycles have an instruction manual attached to its frame or included with the packaged unit. The instruction manual requires:

  • Operations and safety instructions describing the operation of the brakes and gears, cautions dealing with wet weather and night-time operation, and a guide for safe on and off road operation;
  • Assembly instructions for complete and proper assembly;
  • Maintenance instructions for proper maintenance of brakes, control cables, bearing adjustments, wheel adjustments, lubrication, reflectors, tires and handlebar and seat adjustments. Should the manufacturer determine that such maintenance is beyond the capability of the consumer, the instructions must include specific locations where such maintenance service can be obtained.
