Please be advised that this office represents John Jones who received injuries in an automobile collision which took place on January 12, 2009 at the intersection of Con¬gress and Main Streets in the City of Lake Worth Florida.
Mr. Jones' vehicle was struck broadside by a vehicle operated by Mary Smith who had failed to stop for a stop sign at the above intersection. She has stated to police and to us that she was uninsured at the time of this incident. She was cited for failure to yield and for failure to have an insurance card as required by the laws of this state. Enclosed is a copy of our letter to Mrs. Smith which prompted her telephone call to me on February 5, 2009 that she was uninsured. In that conversation I made it clear to her that if she was insured, she was required to contact her carrier. She replied that her policy had been cancelled for non payment two months prior to this incident.
It is our position that Mr. Jones is entitled to receive benefits under the uninsured portion of his automobile policy, a copy of which is enclosed herewith along with the declaration page.
If you require any additional proof, please advise immediately as time is of the es¬sence. It is my practice to provide medical information as it becomes available as well as any other information such as loss of income and medical bills.
