Florida car accident Request for Admissions

REQUEST FOR ADMISSIONS

Plaintiff/Defendant (name of plaintiff/defendant), pursuant to Rule 36, requests that defendant/plaintiff (name of defendant/plaintiff) admit the genuineness of the following documents and the truth of the following statements, within thirty (30) days of the date of service hereof, for use in this proceeding only and subject to all applicable objections interposed at trial.

Documents

2. A copy of the police report annexed hereto as Exhibit A and made a part hereof.

Statements of Fact

1. That on (date), defendant/plaintiff was the (operator/owner) of a motor vehicle which collided with a vehicle (owned/operated by/in which plaintiff/defendant was a passenger).

2. That defendant/plaintiff did not sound the horn of his vehicle or give any other warning to the plaintiff/defendant before the accident.

3. That the following persons were passengers in defendant’s/plaintiff’s vehicle: (known passengers).

4. That there were no other passengers in defendant’s/plaintiff’s vehicle: (known passengers).

5. That defendant/plaintiff gave a statement to (known recipients of statement, including defendant’s/plaintiff’s attorney and his agents).

6. That defendant/plaintiff gave no other statements concerning the accident.

7. Defendant/plaintiff was operating the vehicle with the consent of its owner.

8. That the defendant/plaintiff had operated the subject vehicle on (insert number) occasions before the date of the accident.

9. That the owner of the vehicle had given defendant/plaintiff the following instructions, restrictions or limitations on the use of the vehicle (insert instructions, restrictions or limitations).
