Conversion Action | Nominal Damages and Pecuniary Loss

In a conversion action, nominal damages are available even where the disputed funds are returned or interpled. Additionally, to the value of the item converted, damages may also include the amount of any further pecuniary loss of which the deprivation has been a legal cause and compensation for the loss of use not otherwise compensated. Accordingly in a proper conversion cause of action, lost profits may be recovered where the loss is a proximate result of the defendant's act and where the loss can be shown with reasonable certainty.

The plaintiff should consult with a West Palm Beach conversion lawyer who will advise the plaintiff that in order to recover damages for a conversion action, the plaintiff must demonstrate with sufficient certainty the extent of the pecuniary loss and that the conversion was the legal cause thereof. Another type of conversion action is that in which the plaintiff is unable to find a replacement for the chattel on the market in a prompt manner, and the plaintiff is deprived of use during the period of delay as a result. The plaintiff's loss of the use of that chattel is not made good by a subsequent purchase and it is therefore compensable in a conversion action. Accordingly, the defendant may still be held liable for damages to the plaintiff.

A cause of action for conversion may have many complex issues. Therefore, you should consult with an experienced West Palm Beach conversion lawyer. Call Sharmin & Sharmin P.A. at 1-800-74-TRIAL.
