Car Wreck Demand letters
Demand letters provide the opportunity for your car accident injury attorney to establish credibility with the adjuster. The most effective way of establishing credibility, in my opinion, is by making statements that are backed up by facts. Facts include medical reports, loss of wage reports, and specific documented evidence of future medical costs.
Writing an effective demand letter means being able to establish credibility and not to exaggerate your, the client's, losses but to establish them with credibility and specificity. Your car accident injury attorney should be able to convince an insurance adjuster that there are concrete losses that the defendant will eventually have to answer for at trial. One of the things that sticks out in my mind when I think about the concept of pain and suffering in terms of getting recovery for an injury victim is that most injury attorneys do not separate pain and suffering . But car accident pain and suffering cannot be lumped together as if they were one.
Pain is the physical manifestation of injury and suffering is a psychological response that the injured victim has with respect to pain. For example, suffering includes limitations on a person's ordinary activities. With respect to pain for example: a car crash victim who once went out to dinner with this spouse once a week, can no longer do that anymore because he cannot sit for long periods of time. His need to stand and to walk about after a few minutes would disrupt the dinner process and would likely make others in the restaurant feel puzzled or uncomfortable. Suffering is that psychological response that a person who has been injured in a car crash feels with respect to the pain.
If your car accident injury attorney is going to mention pain and suffering in your demand letter, you have to make sure that your attorney knows not only about the pain you are feeling, but knows of the suffering as well. You have to provide specific examples of suffering so that your attorney can articulate them to your benefit.
Another factor that can enhance the demand letter are the miscellaneous expenses that the car crash victim has to endure. For example, costs associated with traveling to medical visits, orthopedic devices, the cost of services such as a babysitter or a housekeeper who needs to watch over your home while you are out getting medical treatment are expenses that should not be overlooked. Keeping an exact detailed record of those little losses sends the message to the insurance adjuster as well as an eventual defense attorney that both you and your car accident injury attorney are serious about damages and have a methodical way of documenting those damages and will eventually present them to a jury for compensation.
