A: Diversity refers to where the plaintiffs and defendants reside. If the plaintiff and defendant are both from Florida, there is no diversity and the plaintiff may sue in state court without the defendant being able to remove the suit to federal court. If the plaintiff resides in West Palm Beach, Florida and the defendant resides in Atlanta, Georgia, the defendant may claim diversity and seek to remove the case to federal court. If there is more than one defendant and even one resides in Florida, then there is no diversity even if all the other reside outside that state of Florida.
