What does a plaintiff have to prove to prevail in a wrongful death case?

 

A: The Plaintiff must prove the commission of a tortious act; that the tortious act resulted in the decedent's death; the decedent would have recovered damages had death not ensued; and that damages for the wrongful death are recoverable by the personal representative on behalf of the decedent's survivors and/or the estate.
